Dadurch konnte die für eine Abschaltung notwendige Auftriebssicherheit des Haltepunkts Marienhof innerhalb der ursprünglich vorgesehenen Vertragslaufzeit nicht erreicht werden. Der gebundene AN ist mit der Herstellung des Rohbaus des Hp Marienhof beauftragt. Dies beinhaltet im Rahmen der WH auch den Betrieb einer Vielzahl von Pumpen innerhalb der Brunnen sowie die Überwachung der Wasserstände.

Die Leistungen sind technisch untrennbar mit den bereits vertraglich gebundenen WH-Leistungen verbunden und Bestandteil eines integralen Gesamtsystems (Planung, Betrieb, Überwachung, Steuerung).

Bei Bindung eines weiteren AN ensteht eine kritische Schnittstelle zwischen den parallelen Wasserhaltungsfunktionen (Betrieb, Steuerung, Alarmierung, Notfallkonzepte). Komplikationen sind bei dem Gewerk der Bauwasserhaltung unbedingt zu vermeiden, da ein längerer Ausfall bestimmter Brunnen ggf. mit kritischen Auswirkungen auf die zulässigen Wasserstände einhergeht bzw. den Baufortschritt massiv einschränken kann. Bei der Durchführung der o.g. Leistungen durch einen weiteren AN ist die scharfe Trennung der Leistungen zudem massiv erschwert. Für den AG ist nicht mehr hinreichend erkennbar, welchem AN gegenüber er ggf.
