Gemäß BE-Plan der 5.Planänderung sind von der ATH die ihr vertraglich zugesicherten BE-Flächen zu beräumen um Baufreiheit für die VHM U9 zu gewährleisten. Die Rückgabe der BE-Flächen muss der ATH angeordnet werden. Die Beräumung des Baufeldes Süd durch die ATH erfolgt in mehreren Schritten. Bei dem Umzug der Wasseraufbereitungs- und Druckerhöhungsanlage handelt es sich um eine für den weiteren Baufortschritt unabdingbare Maßnahme.
Zum Zeitpunkt des Vertragsabschlusses der gegenständlichen VE30 war nicht bekannt, das für die LHM im Bereich des HBF eine weitere U Bahnstation erstellt wird. Dies führte zu der in der 5.
