Zusätzlich ist gemäß § 22 Abs. 2 VOB/A EU eine Änderung des öffentlichen Auftrages ohne ein neues Vergabeverfahren zulässig. Wenn zusätzliche Bauleistungen erforderlich werden und ein Wechsel des Auftragnehmers aus wirtschaftlichen und technischen Gründen nicht sinnvoll ist, da dies mit erheblichen Schwierigkeiten oder beträchtlichen Zusatzkosten für den öffentlichen Auftraggebern verbunden wäre. 

Eine neue Firma würde zusätzlich die Kosten für die Baustelleneinrichtung in Rechnung stellen, was zu weiteren Zusatzkosten führen würde. Darüber hinaus wäre für den Fachplaner ein höherer Koordinationsaufwand erforderlich, der ebenfalls zu zusätzlichen Beauftragungen führen könnte (Angebotseinholung bei Dritten, Startgespräch etc.).
